Product and Software Integrity

You agree to maintain the integrity of all trackingsystemdirect equipment and software, including refraining from tampering with SIM cards in tracking devices. This also means not using unauthorized equipment to replace batteries, gaskets, or other components. Any charges resulting from modifications to the SIM card or its use in an unregistered device will be billed to you.

Secure Your Account

You are responsible for keeping your login details confidential and must notify us immediately if you suspect unauthorized account access. trackingsystemdirect is not liable for losses due to unauthorized use of your account. You may also be held responsible for losses suffered by trackingsystemdirect or others resulting from such unauthorized access.

Provide Accurate Information

You agree to provide accurate information and notify us of any changes within five business days. Providing false or misleading information constitutes a breach of this agreement, and we reserve the right to terminate services and close your account. We may also investigate your account and use relevant data to respond to legal inquiries or defend against chargebacks.

Payments and Fees

All payments for software, services, and GPS tracking equipment are due at the time of order. Fees are non-refundable and are charged upon device activation. trackingsystemdirect reserves the right to change prices at any time with notice. Payments can be made using a valid credit or debit card. Your billing cycle starts on the device delivery date and runs in advance. Monthly or annual billing options are available.

Cancellations must be submitted in writing at least 10 days before the billing cycle ends to avoid additional charges. If you cancel after billing but before the service start date, a $10 service fee will apply.

Subscription Termination

You may cancel your subscription at any time through the provided cancellation link. Monthly subscriptions will remain active until the end of the current billing cycle. We require a 30-day notice to terminate any real time GPS data plans.

GPS Tracking Data

GPS tracking data is stored for 90 days and is accessible only with an active account. Upon termination of service, all GPS data will be permanently deleted and cannot be restored.

Survivability

Provisions regarding disputes, arbitration, jurisdiction, venue, disclaimers, limitations of liability, and indemnification will remain in effect after this Agreement ends.

Dispute Resolution and Legal Venue

We encourage direct negotiation for any disputes. If unresolved, we may mediate through the American Arbitration Association (AAA) following their Commercial Mediation Rules. Binding arbitration will be conducted under AAA’s rules in Gulfport, Mississippi. If legal action outside arbitration is necessary, both parties agree to the jurisdiction of a court in Riverside County, California.

Warranty Disclaimer

trackingsystemdirect does not guarantee the accuracy, legality, or availability of information accessed via our products or software. We disclaim responsibility for any inaccuracies or omissions. Any damage from downloading or accessing data is solely at your risk.

Limitation of Liability

The reliability of GPS technology depends on factors beyond our control, and we cannot guarantee uninterrupted service. We are not liable for damages, including lost profits or data, resulting from the use or inability to use our products.

Indemnification

You agree to indemnify and hold trackingsystemdirect harmless from any claims, damages, or expenses arising from your breach of this Agreement, negligence, or misuse of our products.

Software Security

Using our products may expose you to open networks and associated risks. You are responsible for taking protective measures, such as using antivirus software. By using our products, you accept these risks and agree to our Terms and Conditions and Privacy Policy.

Terms of Service

If any product or service ordered is found to be out of stock, a refund or credit will be issued if payment was collected. Prices are subject to change at any time. Activation and Monthly Data Plan for GPS Devices

Activation Prior to Shipment: trackingsystemdirect will only ship GPS devices that have been activated. Activation is mandatory before dispatch from our facility.

Customer Authorization for Activation: Explicit customer authorization is required to activate the GPS unit. This authorization must be provided through a phone call with our customer service team. Placing an order does not automatically authorize billing for the associated data plan.

Billing of Data Plans: All monthly data plans for real-time GPS devices are billed on the first of each month. It is the customer’s responsibility to ensure timely payment to avoid service interruptions.

Cancellation of Service

Customers wishing to cancel their data plan must provide written notice via email at least 30 days before the desired cancellation date. Upon receiving the cancellation request, trackingsystemdirect will send a confirmation email to acknowledge receipt and begin processing the cancellation.

If the customer does not receive a confirmation email within 48 hours, they must contact customer service to avoid continued billing. It is the customer’s responsibility to confirm receipt of the cancellation request and ensure it has been processed. Failure to follow up may result in additional charges.

By purchasing a GPS device and data plan from trackingsystemdirect, the customer agrees to these terms and conditions.

The cardholder or purchaser will be liable for all fees, including civil, legal, administrative, and collection costs required to resolve the dispute. If a dispute results in the reversal of payment by the issuing creditor, trackingsystemdirect will pursue collections through alternative means, and any additional costs will be added to the settlement amount. These costs are the sole responsibility of the individual who placed the order or the cardholder.

Any legal action arising from a dispute may result in a judgment that could negatively affect the cardholder’s credit score or rating. trackingsystemdirect and its partners are not responsible for any fees or costs associated with disputed transactions.
